The Developer’s Blueprint: How to Write a DMCA Notice That Actually Works

English Version (En) Title: The Developer’s Blueprint: How to Write a DMCA Notice That Actually Works

Finding your app on a pirate site is frustrating, but sending a vague "please delete this" email won't work. To get content removed, you must follow the strict legal requirements of the Digital Millennium Copyright Act. If your notice is missing even one required element, the host can legally ignore it.

The 6 Essential Elements of a Valid DMCA

To be legally "compliant," your notice must include these six items:

  1. Signature: A physical or electronic signature (typing your full legal name at the bottom counts).
  2. Identification of the Original Work: A link to your official website or App Store page to prove you are the creator.
  3. Identification of the Infringing Material: The exact URLs of the pirate files or the page hosting them.
  4. Contact Information: Your name, physical address, email, and phone number.
  5. The "Good Faith" Statement: A sentence stating you believe the use of the material is not authorized by you or the law.
  6. The "Perjury" Statement: A declaration that your information is accurate, made under penalty of perjury.

Forms vs. Emails: Which is Better?

Most major platforms (Google, GitHub, Meta, Cloudflare) provide specialized Web Forms. Always use the form if it’s available.

  • Why Forms Win: They are processed by automated systems, meaning the takedown happens faster. They also ensure you don't forget any legal "magic words."
  • When to use Email: Only if the site is a small, private host with no automated system. In this case, send your notice to the "Designated Agent" listed in the site’s footer or Whois records.

Pro Tip: The Section 1201 "Circumvention" Clause

For developers, piracy often involves "cracking" a license check. In your notice, mention DMCA Section 1201. This part of the law specifically prohibits bypassing "technological measures" (like your app's encryption or license server). Mentioning this makes it clear that the pirate isn't just sharing a file—ils are breaking a security lock.

Copy-Paste Template for Software Piracy

Use the following text for your email notices:

Subject: Copyright Infringement Notice - [Your App Name]

To the DMCA Agent,

I am the copyright owner of the software "[App Name]". It has come to my attention that your service is hosting infringing copies at the following locations:

[Insert Pirate URL 1]

[Insert Pirate URL 2]

My original work can be verified at: [Link to Play Store/Official Site]

I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

The information in this notification is accurate, and under penalty of perjury, I am the owner of the copyright that is allegedly infringed.

Sincerely,
[Your Full Name]
